These Terms and Conditions govern the public-voting extension of the Nutrific Heritage Day Competition. By casting a vote, a participant agrees to be bound by these Terms and Conditions.
1 Promoter
1.1 The competition is conducted by Alpen Food Company (Pty) Ltd, the owner of the Nutrific brand (the "Promoter").
1.2 Competition enquiries may be directed to hello@nutrific.co.za.
2 Competition period
2.1 The competition opens at 08:00 SAST on Wednesday, 28 October 2026 and closes at 23:59 SAST on Sunday, 8 November 2026 (the "Competition Period").
2.2 Votes received after the closing time will not be counted.
3 Relationship to the original Heritage Day Competition
3.1 This competition is a follow-on public-voting phase arising from the Nutrific Heritage Day Competition.
3.2 Five winners were selected in the original Heritage Day Competition and each secured 1,000 Nutrific breakfasts for an Educare of their choice. For purposes of this public-voting phase, those five winners are referred to as the "Featured Winners".
3.3 The public vote does not reopen or alter the results of the original Heritage Day Competition. The prizes already awarded to the five Featured Winners remain unaffected.
4 Featured Winner stories and content
4.1 The Featured Winners' names, social-media handles, written stories, voice recordings, photographs, videos and other footage displayed in connection with this competition (the "Featured Winner Content") will be used under permissions obtained separately from the Featured Winners and, where applicable, from other identifiable people appearing in that content.
4.2 Subject to those permissions, the Promoter and its appointed agencies and service providers may reproduce, publish, display, distribute and promote the Featured Winner Content in connection with the original Heritage Day Competition, this public-voting competition, winner and Educare announcements, Nutrific's website and social-media channels, organic and paid advertising, public relations and related follow-up content arising directly from these campaigns.
4.3 Subject to the permissions obtained, Featured Winner Content may be edited, cropped, resized, colour-corrected, captioned or subtitled; combined with music, voice-over, text or graphic elements; and adapted into short-form or animated video, provided that it is not used in a way that materially misrepresents, demeans or causes unreasonable harm to a person depicted or quoted.
4.4 A Featured Winner who voluntarily supplies further content in connection with this campaign confirms that they own the content or have authority to supply it, and that they have obtained informed permission from every identifiable adult appearing in it. Where an identifiable child appears, prior written consent must have been obtained from that child's parent, legal guardian or other legally competent person. The Promoter may request proof of those permissions before publishing the content.
4.5 The Promoter may decide not to publish any Featured Winner Content and may remove content where reasonably necessary.
4.6 Participants in the public vote receive no ownership of or right to download, reproduce, distribute or otherwise use the Featured Winner Content.

5.1 The competition is open to a person who:

6.4 Each eligible person who casts a valid vote automatically receives one entry into the random voter draw.
7 Prizes
7.1 A total of 2,000 Nutrific breakfasts will be awarded during this public-voting phase.
7.2 Story Prize. The Featured Winner whose story receives the highest number of valid votes will secure an additional 1,000 Nutrific breakfasts for that Featured Winner's nominated Educare.
7.3 Voter Prize. One eligible voter will be selected at random and invited to nominate one qualifying South African Educare to receive 1,000 Nutrific breakfasts.
7.4 The selected voter does not receive the Nutrific product personally. The product will be delivered directly to the approved Educare.
7.5 Each 1,000-breakfast prize consists of 4 cases of Nutrific Wholewheat Biscuits (a total of 2,304 breakfast biscuits equaling 1,152 portions), with an approximate retail value of R3,000.
7.6 A prize may not be exchanged for cash, transferred or substituted by a Featured Winner, selected voter or recipient Educare.
8 Determining the winning story
8.1 The Featured Winner whose story receives the highest number of valid votes at the close of the Competition Period will receive the Story Prize for their nominated Educare.
8.2 The Promoter may investigate and exclude fraudulent, automated, duplicate or otherwise invalid votes.
8.3 If two or more stories receive the same highest number of valid votes, the winning story will be selected through an independently supervised random draw between the tied Featured Winners.
9 Selecting the voter
9.1 The voter will be selected at random from all eligible people who cast a valid vote before the competition closes.
9.2 The draw will take place by Wednesday, 11 November 2026 and will be independently overseen.

10.2 The selected voter must respond and provide the required verification information within three business days.
10.3 The selected voter may be required to provide proof of identity, age and South African residence.

12.2 Delivery is intended to take place within 30 business days after verification, subject to product availability and reasonable delivery arrangements.
13 Announcement
13.1 The verified results are expected to be announced on the Nutrific Facebook page and campaign webpage on or about Thursday, 12 November 2026.
13.2 If verification takes longer, the Promoter will publish an updated announcement date.
14 Personal information
14.1 Personal information collected from participants will be processed only to administer the competition, verify eligibility, contact the selected voter, arrange the prize, prevent fraud and comply with legal requirements.
14.2 The official voting form is hosted by Jotform, which processes the information submitted through the form to provide the voting form service. The Promoter may share necessary personal information with its appointed agencies, service providers and professional advisers solely for the purposes in clause 14.1.
14.3 Personal information will not be used for unrelated direct marketing without consent and will be retained only for as long as reasonably necessary or legally required.
14.4 A participant may contact hello@nutrific.co.za to request access to or correction of their personal information, subject to applicable law.
14.5 The selected voter and the Featured Winner whose story receives the highest number of valid votes may be invited to participate in additional publicity not already covered by an existing content release. Participation in additional publicity is voluntary and may be declined without affecting any prize.
15 Facebook
15.1 This competition is not sponsored, endorsed or administered by, or associated with, Facebook.
15.2 By participating, each participant releases Facebook from claims arising from the competition to the extent permitted by law.
15.3 Voting takes place through the official voting form, not through Facebook. Participants who use Facebook to view or share campaign content must comply with Facebook's applicable terms and policies.
16 Competition administration
16.1 The voting result and random voter draw will be overseen and certified by an independent accountant, registered auditor, attorney or advocate as required by applicable South African promotional-competition regulations.
16.2 The Promoter will retain the competition records required by law for the legally prescribed period.
16.3 The Promoter's decisions concerning eligibility, the validity of votes and administration of the competition are final, subject to applicable consumer-protection law.
17 General
17.1 The Promoter may disqualify participation that is fraudulent, dishonest, automated or contrary to these Terms and Conditions.
17.2 If a technical failure, platform interruption or circumstance beyond the Promoter's reasonable control affects the fairness or proper administration of the competition, the Promoter may suspend, extend, modify or terminate the competition and take reasonable corrective action, subject to applicable law.
17.3 The Promoter is not responsible for a vote that is delayed, lost, incorrectly recorded or not received because of a technical failure outside the Promoter's reasonable control.
17.4 Nothing in these Terms and Conditions excludes or limits any consumer right that cannot lawfully be excluded or limited.
17.5 Participation in the competition constitutes acceptance of these Terms and Conditions.
